Article 1 - (Purpose)
The purpose of this Law shall be to establish the Korea Advanced Institute of Science (hereinafter referred to as the Institute), which shall educate such persons with both profound theories and practical adaptability as are required in the fields of science and technology for industrial development.

Article 2 - (Legal Entity)
The Institute shall be a legal person.

Article 3 - (Establishment)
1. The Institute shall be established when the Minister of Science and Technology registers it at the location of the main office of the Institute after obtaining the concurrence of the Minister of Education.
2. The Minister of Science and Technology shall set down the Articles of the Institute including the following items after obtaining the concurrence of the Minister of Education:
i. Purpose
ii. Name
iii. Location of offices
iv. Necessary provisions for number of officers and the conditions of their appointment and dismissal
v. Necessary provisions for Board of Trustees
vi. Necessary provisions for revisions of articles
vii. Necessary provisions for dissolution
viii. Necessary provisions for public announcement

Article 4 - (Registration of Establishment and so forth)
Matters necessary for establishment of the Institute and other registrations shall be prescribed by a Presidential Decree.

Article 5 - (Prohibition to use Similar Name)
No person or agency, other than the Institute, mayuse the same or similar names as the Korea Advanced Institute of Science.

Article 6 - (Officers)
1. There shall be not more than fifteen trustees and not more than two auditors of the Institute. The term of trustees and auditors shall be presceibed by the Articles of the Institute.
2. Trustees and auditors shall be appointed by the Board of Trustees as prescribed by the Articles of the Institute. The appointments of officers must first be agreed upon by the Minister of Science and Technology. The approval of the Minister of Education must be obtained before it becomes final.
3. The Chairman of the Board of Trustees shall be elected by the Board of Trustees from among the Trustees as prescribed by the Articles of the Institute. The Chairman of the Board of Trustees shall not be eligible for appointment to the presidency of the Institute.
4. Matters concerning qualifications, functions, etc. of trustees and auditors shall be prescribed by a Presidential Decree.

Article 7 - (Board of Trustees)
1. There shall be a Board of Trustees to resolve important matters.
2.

The Chairman of the Board of Trustees shall convoke meetings and shall chair the meetings.

3.

The auditors may attend Board of Trustees meetings and shall have the right to speak at those meetings.


Article 8 - (Contributions and so forth)
1.

The Government may grant funds to provide for establishment expenses, construction costs, operational expenses, and an endowment fund for the operation of the Institute.

2.

Necessary provisions for the grant, the use, and the administration of the Government contributions in the preceding paragraph shall be prescribed by a Presidential Decree.


Article 9 - (Lease of National Property, etc.)
1.

The Government may lease free of charge or grant to the Institute such national property as may be required for the establishment and operation of the Institute.

2.

Matters necessary for the content, conditions and procedure of the lease and/or grant provided for in the preceding paragraph shall be prescribed by a Presidential Decree, notwithstanding the pertinent provisions of the National Property Management Law.


Article 10 - (Submission of Business and Budget, etc.)
1.

The Institute shall submit, before the beginning of every fiscal year, its budget and business plan to the Minister of Science and Technology and the Minister of Education as prescribed by a Presidential Decree.

2.

The Institute shall submit to the Minister of Science and Technology and Minister of Education its closing statement of accounts of revenues and expenditures for each fiscal year as audited by a certified public accountant nominated by the Government.


Article 11 - (Dissolution of Remaining Assets)

The remaining assets of the Institute following its dissolution shall be returned to the National Treasury.


Article 12 - (Teaching Staff and Their Qualifications)
1.

There shall be a President, Vice Presidents, Professors, Associate Professors, Assistant Professors and, if necessary, Instructors in the Institute.

2.

Necessary provisions for qualifications of the teaching staff in the preceding paragraph shall be prescribed by a Presidential Decree.


Article 13 - (Appointment and Dismissal Procedures for the Teaching Staff)

The Institute shall appoint and/or dismiss members of the teaching staff in accordance with the following:

1.

The appointment and/or dismissal of the President shall first be passed by the Board of Trustees and must be agreed upon by the Minister of Science and Technology, and then the approval of the Minister of Education must be obtained.

2.

Teaching staff other than the President in the preceding paragraph shall be appointed and/or dismissed by the President as prescribed by the Articles of the Institute.


Article 14 - (Degree Programs and so forth)
1.

There shall be Doctor of Science, Engineer, and Master of Science programs at the Institute.

2.

Matters necesary for departments, syllabi, and curricula of the programs in the preceding paragraph shall be determined by the Insstitute and shall be submitted to the Minister of Education and the Minister of Science and Technology as prescribed by a Presidential Decree.


Article 15 - (Conferring Degrees)
1.

The Institute may confer Doctor of Science, Engineer, and Master of Science degrees as prescribed by its regulations.

2.

The President shall have the right to confer the degrees referred to above. Only the conferring of the Doctor of Science degree must be agreed to by the Minister of Education before it becomes final.

3.

The holders of Engineer degrees and/or Master of Science degrees referred to above shall be registered with the Ministry of Education, as prescribed by a Presidential Decree.

4.

Matters necessary for conferring degrees in the preceding paragraphs shall be prescribed by a Presidential Decree.


Article 16 - (Student)

Matters necessary for student quotas and entrance qualifications shall be determined by the Institute and shall be reported to the Minister of Education and the Minister of Science and Technology as prescribed by a Presidential Decree.


Article 17 - (Special Military Service)

The Government may give special military service treatment to the students of the Institute, as prescribed by a Presidential Decree, notwithstanding the provisions of the Military Service Law.


Article 18 - (Penal Provisions)

Any person having violated the provisions of Article 5 shall be fined an amount not exceeding five hundred thousand won.


Article 19 - (Application of the Civil Law)

Pertinent provisions for a foundation int eh Civil Law, other than those prescribed for a legal entity by this Law, shall be aplied to the Institute.


Article 20 - (Provision for Enforcement)

Necessary provisions for the enforcement of this Law shall be prescribed by a Presidential Decree.


Addenda

This Law shall become effective on or after the date of its promulgation. (This Law was passed in the Korean National Assembly on July 16, 1970 and promulgated on August 7, 1970.)
